AZUREGREEN TRIUMPHANT IN
COURT
The appellate case against AzureGreen,
the Town of Middlefield and the Zoning Board of Appeals has been
decided in favor of AzureGreen owners Tamarin Laurel and Adair
Laurel Cafarella, the town of Middlefield and the Zoning Board of
Appeals.
The Massachusetts Supreme Judicial Court refused to hear any
further appellate review on the part of remaining plaintiff Kathleen
O’Brien. This final ruling granted on September 11,
2007, upholds the decision of the Middlefield Zoning Board of
Appeals to grant a Special Permit for business use in the Business
District. The 2002 Special Permit allows the mail-order
company AzureGreen to build their new 28,800 square foot facility at
16 Bell Road. Preliminary site work for AzureGreen’s project
is now underway.
The Supreme Judicial Court’s recent decision puts an end to
the case that was initially filed in Land Court on April 25, 2002 by
12 Middlefield residents, Mitch Redresser, Maureen Sullivan, John
& Mary Richardson, Kathleen O’Brien, Githa Joszef, Michael and
Ruth Feldberg, Gregory & Elizabeth Carpenter, Joan Almori &
Gail Barre.
